Spousal and Partner Sponsorship in Canada: Requirements and Common Pitfalls
Family sponsorship lets Canadian citizens and permanent residents bring their spouse, common-law partner, or conjugal partner to Canada as a permanent resident. It is one of Canada's most used immigration programs — and one where small documentation mistakes cause long, painful delays.
Who can sponsor
The sponsor must be a Canadian citizen or permanent resident, 18 or older, living in Canada (citizens abroad must show they will return), and must sign an undertaking to support their partner for a set period. There is no minimum income requirement for spousal sponsorship itself, but sponsors must not be barred — for example by a previous defaulted undertaking or certain criminal convictions.
Inland vs outland
Couples living together in Canada can often choose an inland application, which may allow the sponsored partner to apply for an open work permit while waiting. Outland applications are processed through the applicant's country and can be a better fit when the partner lives abroad or needs to travel. Choosing the right stream depends on your circumstances — where you live, travel needs, and status in Canada.
Proving the relationship is genuine
Officers assess whether the relationship is genuine and not entered into primarily for immigration purposes. Strong applications document the relationship's history: photos across time, communication records, joint finances or leases, statements from family and friends, and a consistent, truthful account of how the relationship developed. Gaps and inconsistencies — not small imperfections — are what raise concerns.
Common pitfalls
The most frequent problems we see: incomplete forms and missed signatures, weak relationship evidence organized as a pile rather than a story, undisclosed previous marriages or applications, and misunderstanding common-law requirements (12 continuous months of cohabitation, properly documented).
